Terms and Conditions

DEFINITIONS:

For the purposes of the present General Terms and Conditions, the following terms and expressions are to be understood as meaning:

  • General Terms and Conditions - means the present General Terms and Conditions.
  • Provider - means the trading company VITASLIM INNOVE Ltd., entered in the Commercial Register at the Registry Agency under UIC 200125430
  • Site / E-Shop - means internet address www.bemore.shop
  • User / Consumer - means the persons using and visiting the Site and the e-shop.
  • User Profile - means a separate part of the Site containing user information provided by the User upon registration in the site.
  • Goods (s) - means the goods offered by the Provider via the e-shop.
  • Order - means the Order of the User for certain Goods selected by him, together with the chosen method of payment and receipt of the Goods.
  • Cost of the Goods - means the price per piece or for a certain quantity of goods, denominated in Bulgarian Lev, including value added tax and any additional taxes and fees. The price does not include shipping and delivery costs.
  • Cost of Delivery - means the cost of transport and delivery of the Goods to the User, including value added tax
  • Order Value - means the total cost of the Goods and the Cost of Delivery.

SUBJECT

Art. 1 The present General Terms and Conditions govern the relationship between VITASLIM INNOVE Ltd., UIC 200125430, hereinafter referred to as the PROVIDER, on the one hand, and the persons using the site and the e-shop located at www.bemore.shop, hereinafter referred to as Users / Consumers, on the other hand.

An inseparable part of the present Terms and Conditions is the Data Collection and Protection of Personal Data of VITASLIM INNOVE Ltd.

Art. 2 These terms are binding for all Users. By clicking on any link, button or application on the site, except the link to these General Terms and Conditions, the user is deemed to be notified and agrees with these General Terms and Conditions for using the site and the online store. By accepting these Terms and Conditions, the user also agrees to conclude a distance contract within the sense of the Consumer Protection Act.

GENERAL

Art. 4. E-SHOP is an e-shop available at www.bemore.shop. The site offers products of which the Provider is a direct importer, as well as products of which the Products is a distributor.

Art. 5. Consumers have the opportunity to conclude contracts for the purchase and sale of goods offered by the E-SHOP and to carry out the following actions:

  • To view the content of the website and the products offered freely
  • To register and create an account for the purchase of goods from an E-SHOP
  • To conclude contracts for the purchase and sale of the goods offered by the Provider in its E-SHOP
  • To review the goods, their characteristics, prices and delivery conditions

Art. 6. The Provider shall deliver the goods and guarantee the rights of Consumers provided for by law in good faith and within the terms of the consumer or commercial law practice.

USE OF THE E-SHOP

Art. 7. To use the Provider’s ELECTRONIC SHOP, it is not necessary for the User to register with it.

Art. 8. In case he wishes to register, the User shall enter his name, surname, e-mail and remote access password by registering electronically on the Provider's website. When making the registration, the User is obliged to provide correct and up-to-date data. The user shall promptly update the data specified in his registration in case of change. The registration itself does not bind the User with making certain purchases or additional actions.

Art. 9. The price specified in the e-shop is for 1 pc. in BGN with VAT included. The price of the product does not include the price for shipping.

Art. 10. The price stated in the e-shop, as well as the trade discounts, are valid only when a contract through the e-shop has been signed.

CONCLUSION OF A PURCHASE CONTRACT

Art. 11. The Customer signs a contract for the purchase of the goods offered at www.bemore.shop via the Provider’s interface. The present General Terms and Conditions are an integral part of any contract for purchase. By virtue of the purchase contract concluded with the Customer:

  • The Provider undertakes to deliver and transfer the ownership of the goods the User has ordered to the User.
  • The User pays the Provider the price of the delivered goods within the term and way of payment in accordance with these General Terms and Conditions.
  • The Provider delivers the goods ordered by the Customer within the time limits specified in these General Terms and Conditions.

Art. 12. The User and the Provider agree that all statements between them in connection with the conclusion and performance of the purchase contract may be made by electronic means and by electronic statements within the meaning of the Electronic Document and Electronic Signature Act and Art. 11 of the E-Commerce Act. It is supposed that electronic statements made by Users on the site are made by the persons mentioned in the data provided by the User upon making a registration, if such registration exists.

Art. 13. An order can be made from different sections of the site where there is an order form. Detailed product details contain a brief and detailed description, current photo and price.

Art. 14. When ordering, the user specifies the basic parameters according to the options given in the site: number, delivery, etc. The user must indicate the address, telephone and e-mail to confirm the order he has made so that it can be started. Failure to fill in the feedback fields or to publish wrong, incorrect or inaccurate information does not bind the Provider with the obligation to perform the order and delivery.

Art. 15. The user agrees to express his consent to the order and confirm all details of the order after an employee of the Provider has contacted him by telephone or e-mail.

Art. 16. By clicking on the ORDER button on the Provider's Site, the User performs an action that is a willful expression binding him with the force of a purchase contract.

Art. 17. The Contract shall become effective as soon as the User makes a payment thereon. The Provider undertakes to deliver the goods only after payment of the full amount of the price within the term of the Contract and subject to these General Terms and Conditions.

Art. 18. The Contract shall be accompanied by a cash receipt or an invoice if such was requested by the customer.

TERMS OF DELIVERY

Art. 19. The Provider undertakes to deliver the ordered Goods through a courier company to an address specified by the User or to an office of the courier company. If the User (or a person authorized by him) is not found within the agreed delivery time and cannot be contacted by phone at the time of delivery, the shipment shall be returned to the nearest courier office to be delivered upon request by the user.

Art. 20. The cost of delivery is borne by the user, the price depends on the weight of the goods and the settlement (district towns, villages). Calculated delivery prices apply to orders placed on the geographical territory of the Republic of Bulgaria. Free delivery applies to orders for which the Price of the Goods exceeds BGN 29.99.

Art. 21. If the User has indicated another person to accept the consignment on his behalf, then the User that has made the initial order shall have no right to objections regarding the delivery and no right to request its return.

Art. 22. The Provider shall not be held responsible for delay if the delay is due to a courier or other provider.

DAMAGED OR DEFECTIVE GOODS UPON RECEIPT

Art. 23. Upon receipt of the goods, the buyer is obliged to immediately examine them and, in the event that he finds visible deficiencies and / or lack of any accompanying documents required by the Bulgarian legislation, he immediately informs the person performing the delivery as well as the Provider. Claims are approved only in cases where there is a completed statement of findings. Claims without a properly filled statement will not be considered for approval. If he fails to do so, the Goods are deemed approved and the buyer loses the right later to claim that the item was delivered with obvious defects or omissions.

Art. 24. In the event of any external damages, including damage, hits and other damages found upon delivery, the User shall sign a damage report in the presence of the courier describing the defects found and shall promptly notify the Provider. Courier costs for the return of defective or damaged goods are at the expense of the Provider.

WITHDRAWAL FROM A DISTANCE CONTRACT

Art. 25. A consumer of the E-SHOP, having the capacity of a consumer within the meaning of the Consumer Protection Act, shall be entitled, without due compensation or penalty and without giving any reason, to withdraw from the concluded contract within 14 working days as of the date of receipt of the goods. Within the aforementioned period, the User is obliged to store the goods received by the Provider, ensuring their quality and safety.

Art. 26. The right of withdrawal under Art. 25 may be exercised only if the products are in their original packaging and appearance.

Art. 27. The right of withdrawal under Art. 25 of these General Terms and Conditions may be exercised after the User has informed the Provider in advance by telephone at 02 944 26 27 or by email at orders@vitaslim.bg within the term stipulated by the law.

Art. 28. The Consumer exercising his right to withdraw from the distance contract under Art. 25 shall send the goods back to the merchant by courier at: 1113 Shipchenski Prohod Blvd., Sofia 1113, Galaxy Trade Center, without undue delay within 14 days as of the date of receipt of the goods.

Art. 29. In the event that the User has paid to the Provider the goods he wishes to return by means of payment upon delivery, the return shall also be made by a courier shipment with payment upon delivery (payment must be equal to the price of the goods) with a review option included. The Provider undertakes to refund to the User the value of the order by paying the amount upon delivery after a careful review of the returned merchandise.

Art. 30 In case the payment is made by bank card, the refund is made by a reverse transaction on the card with which the payment was made within 14 days.

Art. 31. The User exercising his right of withdrawal from the distance contract under Art. 25 shall pay the direct costs of returning the goods to the Provider, including the cost of courier services.

PERSONAL DATA

Art. 32. By accepting the General Terms and Conditions, Users agree that the Provider and its authorized employees have access to the information submitted when registering the User Profile and ordering the Goods.

Art. 33.1. All User's voluntarily provided personal data and other data necessary for his identification during the use of the Site is stored, processed and used by bemore.shop for the purpose of maintaining certain functionalities of the services offered and for the purpose of advertising goods and services offered by VITASLIM INNOVE Ltd. Bemore.shop notifies and declares explicitly to the User that the Personal Data provided by the User shall not be given to third parties for advertising and promotional purposes.

Art. 34. The Provider is a registered administrator of personal data in accordance with the Bulgarian legislation and ensures its protection in accordance with the Law on Personal Data Protection and the related by-laws. By accepting the General Terms and Conditions, Users agree that the Provider may process the personal data provided for the purposes of technical management of the e-shop and its database, contacting the User, managing the Orders, delivering Goods and any other activities related to the performance of the Provider's and Consumers' obligations, and to measure the effectiveness of the Provider’s services, advertising campaigns, marketing and market research, pricing policy; sending promotional offers and materials, provider's product information, and other similar information by mail, telephone or e-mail as well as other commercial communication.

Art. 35. By accepting the General Terms and Conditions, the User agrees that in connection with the processing of the personal data for the purposes referred to in Art. 33, the Provider may also provide this data to third parties with whom it cooperates, works or has other relations in relation to its activity - courier and forwarding companies, etc.

Art. 35.1. The User agrees the personal data declared by him and copies of personal documents to be provided by bemore.shop to Unicredit Bulbank or PayPal when this is necessary and in connection with a payment method chosen by the user.

Art. 36. On the grounds of Art. 34a of the Personal Data Protection Act Users may object to the use of personal data, disclosure to third parties and their use on their behalf for the purposes stated. Users have the right to object to the processing of their personal data for direct marketing purposes and to request their deletion by sending a written email to: gdpr@vitaslim.bg.

Art. 37. The User may at any time waive the receipt of direct mail from the Provider, including information about products, campaigns, promotions, etc., by sending a message to that effect to e-mail: gdpr@vitaslim.bg

Art. 38. At any time, the Provider is entitled to require the User to legitimize and certify the authenticity of each of the circumstances and personal data announced during the registration.

Art. 39 The Provider may use cookies in its e-shop. In this way, the Provider can obtain information about the state and city where the User is located; the user's gender, device, operating system, and browser that the User uses during his visit to the site and the e-shop www.bemore.shop. This data is aggregated with the data of the other site and e-shop visitors, and through them the User cannot be personally identified. The data obtained serves to analyze the user behavior on the website and e-shop of VITASLIM INNOVE Ltd.

Art. 40. The User may at any time prohibit the use of cookies by setting the appropriate settings in the browser he is using.

AMENDMENT TO THE GENERAL TERMS AND CONDITIONS

Art. 41. The Provider has the right to modify the terms of this online store (e-shop) unilaterally and at any time, and after the change, the date of the last update is disclosed. Unless otherwise stated, these changes will take effect immediately and are binding for all Users.

Art. 42. It is the User's responsibility to get acquainted with the current terms and conditions for using the site.

Art. 43. Changes to these General Terms and Conditions do not affect the contractual relationship between the Provider and the User arising prior to the change.

RESPONSIBILITIES

Art. 44. The Provider shall not be held liable for any possible deficiencies related to the timeliness of the information in the e-shop. The Provider is not responsible for the consequences, including any damage caused by or in any way connected with the access or use of the E-shop. The Provider is not responsible for the integrity of the information on the site regarding computer viruses or other threats. The information provided in the site is in compliance with the applicable legislation, its use by the users is voluntary and on their own initiative.

Art. 45. In case of technical errors in the information published on the Site, as a result of which the order cannot be executed, the Provider has the right to refuse the execution of the order, without due compensation to the User, except for refunding the amounts paid by the consumer for the canceled order, if any.

Art. 46. ​​The Provider shall not be held responsible for any damages caused to the user when using the services on the site.

Art. 47. The Provider shall not be held responsible for the sudden depletion of stocks.

Art. 48. The Provider shall not be held responsible for inaccuracies in the product information submitted by the manufacturer.

Art. 49. The Provider shall not be held responsible for any delay or non-performance of its obligations for reasons beyond the control of the company.

Art. 50. The Provider undertakes to observe the arrangements with the user with due care.

OTHER

Art. 51. Users may make free use of site resources except for the limitations outlined in these General Terms and Conditions and other general limitations.

Art. 52. The Provider is entitled at any time, without notice, to terminate the User's access to the E-Shop if the User is in breach of these General Terms and Conditions. The Provider is not responsible for any damages and lost profits incurred in connection with the termination of access to the e-shop.

Art. 53. The colors of the goods displayed in the Provider’s Online Store depend on the settings of the monitor or device of the User.

Art. 54. The provided information and photographic material are subject to the Provider’s copyright. The uploading or printing of pages from the site is admissible in case the COPYRIGHT AND RELATED RIGHTS ACT is not violated. Site users may not copy, distribute or use texts, pictures, images or parts of the site without the express permission of the Provider.

Art. 55. Site users are not entitled to act in violation of generally established rules of communication, to commit malicious acts, to distribute viruses, etc., infringing or damaging the rights or interests of third parties. They have no right to perform orders on behalf of another person without his consent.

Art. 56. Any invalidity of any of the provisions of these General Terms and Conditions shall not invalidate the other provisions.

Art. 57. For all issues not settled in these General Terms and Conditions, the applicable legislation in the Republic of Bulgaria shall apply. For all disputes arising in the interpretation of these General Terms and Conditions, both Parties undertake to endeavor to settle them by agreement, and where this is not possible, disputes shall be referred to the relevant competent authorities.

Art. 58. The Provider reserves the right at any time to change the prices stated on the Site at its sole discretion without being obliged to notify Users in advance. The User is required to pay the price indicated on the Site at the time of the order, whether lower or higher than the updated price.

Art. 59. The term for the delivery of goods ordered by an order may be extended on public holidays and / or off-days by the non-working days. In other cases, there may be a delay in the delivery times specified, to which you will be informed promptly by our associate.

Article 60. All promotional prices and discounts are subject to availability.
